-Failure to pay may result in suspension or termination of your account

8. Disclaimer of Warranties :
SECTION A: PRODUCT WARRANTIES AND DISCLAIMERS
LIMITED WARRANTY FOR CONSUMER PRODUCTS
All New “Ingersoll” Outdoor Power Equipment Manufactured by Ingersoll Tractor Company Are Sold Subject to the Following Warranty
THE INGERSOLL TRACTOR COMPANY, 12911 STANTON ST, WEST OLIVE, MI 49460 THE INGERSOLL TRACTOR COMPANY MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED [INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS] except Company warrants new “Ingersoll” outdoor power equipment (except tires, tubes and batteries) the ORIGINAL PURCHASER (“purchaser”) as follows:
a. HOMEOWNER CONSUMER: That for a period of twenty-four (24) consecutive months from the date of delivery of a new “Ingersoll” product to the ORIGINAL PURCHASER, Selling Dealer (“dealer”) will repair or replace at dealer’s business location each part of said product which is proven to the satisfaction of the company to have been defective in material or workmanship.
b. INSTITUTIONAL - COMMERCIAL OWNER: That for a period of twelve (12) consecutive months from date of delivery of a new “Ingersoll” product to the ORIGINAL PURCHASER, Selling Dealer (“dealer”) will repair or replace at the dealer’s business location each part of said product which is proven to the satisfaction of the company to have been defective in material or workmanship.
It is understood that purchaser will pay dealer for travel time and expense if the purchaser chooses to have dealer repair said product at another location. Purchaser will also reimburse dealer for travel time and expenses if the purchaser chooses to have dealer pick-up product and/or return same to purchaser’s location.
This warranty shall not apply to any part of said new “Ingersoll” product which, in the judgment of the dealer or company, has been subjected to misuse, negligence, unauthorized alteration, or accident, or which has served its normal wear life. The provisions of the warranty do not apply to damage or failures caused by the use of unauthorized attachments, accessories, or parts.
IN NO EVENT SHALL DEALER OR COMPANY BE LIABLE FOR SPECIAL OR CONSEQUENTIAL DAMAGE OF ANY KIND OR NATURE.
DEALER AND COMPANY MAKE NO WARRANTY WHATSOEVER TO TIRES, TUBES, AND BATTERIES, NOT MANUFACTURED BY THE COMPANY, ALTHOUGH THESE ITEMS MAY BE WARRANTIED BY THEIR RESPECTIVE MANUFACTURERS.
This warranty does not apply to used or “second-hand” machines.
THE DURATION OF ANY OTHER WARRANTIES INCLUDING IMPLIED WARRANTIES OR MECHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE LIMITED TO THE APPLICABLE 24 OR 12 MONTH PERIOD OF THIS LIMITED WARRANTY.
No representative of the company or dealer has authority to change the terms of this warranty in any manner whatsoever and no assistance to purchaser by the dealer or company in the repair or operation of the said new “Ingeroll” product shall constitute a waiver of the conditions of this warranty, nor shall such assistance extend or revive it.
Note: Some states do not allow limitations on how long and implied warranty lasts or do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you (purchaser).
Note: Some jurisdictions do not allow the exclusion of certain warranties. If you reside in such a jurisdiction (including but not limited to Australia and the EU), these disclaimers apply only to the maximum extent permitted by local law.
This warranty gives you specific legal rights, and you (purchaser) may also have other rights which vary from state to state.
The foregoing warranty is not applicable to those new “Ingersoll” products, parts, or components that are covered by separate and specific warranties
Dealer will ask the purchaser to sign a form entitled the “Owner Warranty Registration.” Completion of this form is necessary to initiate warranty coverage. A copy of the form will be given to the purchaser. The serial number(s) of the product(s) covered by this warranty, date of delivery (Dely Date), and Warranty Expiration Date (Warranty Exp. Date) are shown on this form.
To obtain performance of any warranty obligation, contact the selling dealer.
SECTION B: WEBSITE USE AND "AS IS" AVAILABILITY
